The DECLARATION of the Parliamentary Advocates with reference to the events of April 7, 2009
The Parliamentary advocates vehemently condemn the violent actions committed in the protest actions of April 7, 2009. The freedom of assembly and expression represent fundamental rights and the state is compelled to execute its positive and negative duties for their accomplishment.
The events that occurred on April 7, 2009, exceeded all guaranteeing and achieving framework of the fundamental right and there is nothing to justify the attested excessive violence. In this connection, we are demanding the authorities to investigate, according to the legal framework, the violations that have led to the events’ proceeding, to identify the instigators and the agent provocateurs of the criminal actions by their responsibility involvement and to undertake all measures which are required in order to ban the recurrence of such situations.
At the same time, the parliamentary advocates are expressing their concern about the fact that the violent actions allowed in the recently held protest, being, in fact, intolerable for a democratic state of law, in which the human dignity, the rights and freedoms, the free development of human personality, justice and political pluralism represent supreme values and are guaranteed, involves already solutions with undesirable repercussions.
In this context, the parliamentary advocates require all competent authorities to make efforts and to undertake all legal measures in order to prevent the violation of human rights and freedoms, namely: - to guarantee the observance of the freedom of assembly, as a condition of free expression of opinions; - to guarantee the individual liberty and security of the person; - to guarantee the constitutional right of the citizens to physical and mental integrity; - to guarantee the constitutional right of the citizens to free movement; - to guarantee the person's right to have access to correct and transparent information.
